Talos is mantling the place of Lorkhan as the god of humans, therefore it's arguable that he's an Aedra too, but this one I agree is fuzzy.
Trinimac was unarguably an Aedra (he was the god of Honor, War and Nobility) because he gave his essence to create Nirn, but then he lost a duel to Boethia and got forcibly turned into the Daedric Prince Malacath.
Overall I think the number of Aedra and Daedra fluctuates, but the *correct* number is supposed to be 8/16 so everyone unknowingly strives to achieve that.

That's true but we don't count Nirn as an Aedric Plane because it's the Aedra's communal big project. They created Nirn and then fucked off to create their own realms, which are either the planets orbiting Nirn or separate planes in Aetherius (or both).
As for Malacath/Trinimac it still doesn't annul the fact that his essence shaped Nirn so he's an Aedra either way, which is why I hold the theory that the number always fluctuates slightly but some cosmic force of balance makes it go to 8/16 in one way or another.

The literal definition of an Aedra is that they contributed to Nirn's creation—which Trinimac has undoubtedly done, it's just that after his contribution he was chewed and shat out by Boethia, thus turning him into a Daedric prince. It's also why the Ashpit is so half-baked: he lost most of his power on Nirn, thus rendering him unable to shape his newfound realm of Oblivion into something proper.
It doesn't matter that he's a Daedric Prince now. He was originally an Aedra.
As for Nirn, it's the *Mortal* Plane, not an Aedric Plane. Nirn is actually a finite place, which makes it distinct it from the planets orbiting it because each one is infinite (like most realms of Oblivion).
